- Rule Making filed October 10, 2007 Dear Mr. Chafin and Mr. Brown: This is in response to the Petition for Rule Making that you filed on October 10, 2007, requesting that the Commission propose to expand the frequencies on which an amateur station operating as a repeater (repeater station) may operate. Specifically, the Petition requests that the Commission amend Section 97.205(b) of the Commission's Rules to allow repeater stations to transmit in the 145.5-145.8 MHz frequency segment of the 2 meter (m) amateur service band (144-148 MHz), in addition to the 2 m band frequency segments currently authorized for repeater station operation. For the reasons set forth below, we deny the Petition. The Petition argues that additional spectrum is needed for

We will make this change because the Enforcement Bureau (EB) no longer uses the term ``Engineer-in-Charge'' (EIC) and because the EIC function is now performed by a District Director in EB. Additionally, we will delete the definition of EIC from Section 97.3(a). Fourth, we also note that the rules applicable to repeater stations are found in Sections 97.203(h) and 97.205 of our Rules. We will consolidate these rules in Section 97.205 by redesignating Section 97.203(h), a notification requirement applicable to a repeater within 16 km of the Arecibo Observatory, as Section 97.205(h). We believe that consolidating the rules in one section will simplify their use for licensees. Fifth, the international Radio Regulations have been amended to require that, as of

- coordinated repeater NA4MB. Your repeater transmits analog voice communications using emission type F3E. The NA4MB repeater transmits digital communications between user stations using the "D-Star" protocol. We note that the definition of a repeater station does not depend upon the emission type or designator and therefore we treat this complaint as a complaint regarding interference between two coordinated repeaters. Section 97.205(c) of the Commission's rules, 47 C.F.R. S: 97.205(c), states that where there is interference between coordinated repeaters, the two station licensees are equally and fully responsible for resolving the interference. Sincerely, W.
